Terms of Use Agreement for Medicare Insurance Services

Effective Date: This Terms of Use Agreement (“Agreement”) is effective as of the Last Updated date above for all users of the Services.
1. Acceptance of Terms
By accessing or using the website medicarequoteforyou.com (the “Service”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use. This Agreement constitutes a binding contract between you and MedicareQuoteForYou.com (“we,” “us,” or “our”) and governs your use of all Medicare plan comparisons, enrollment assistance services, and educational content provided through our Service. If you do not agree to these terms, you must not access or use the Service.
2. Medicare-Specific Provisions
Eligibility: This Service is available only to the following individuals:
Individuals who are 18 years of age or older and are researching Medicare options.
Beneficiaries who are eligible for Medicare (typically age 65 or older, under 65 with certain disabilities, or individuals of any age with End-Stage Renal Disease (ESRD)).
Authorized caregivers, legal guardians, or individuals holding a valid power of attorney for an eligible Medicare beneficiary.
Plan Information:
All data regarding Medicare Advantage (Part C), Medicare Part D (prescription drug), and Medicare Supplement (Medigap) plans is sourced directly from insurance carriers and their published materials.
All information, including premiums, deductibles, drug formularies (lists of covered medications), and provider networks, is subject to change by the insurance carriers and the Centers for Medicare & Medicaid Services (CMS).
Final enrollment in any plan is contingent upon verification of your valid Medicare Beneficiary Identifier (MBI) and approval by the chosen insurance carrier.
3. User Responsibilities
As a condition of your use of our Service, you agree to:

4. Intellectual Property Rights

The “MedicareQuoteForYou” name and logo are registered trademarks and may not be used without prior written consent.
You are prohibited from: (a) scraping, copying, or downloading plan data for any commercial use; (b) modifying, reverse engineering, or creating derivative works based on our Medicare comparison tools; or (c) redistributing, selling, or licensing any content from the Service without our express written permission.
5. Disclaimers & Limitations of Liability
Service Status: MedicareQuoteForYou.com is an independent, licensed Medicare insurance marketplace. We are not:
A Medicare-contracted insurance carrier.
Endorsed or affiliated with the U.S. government, the Centers for Medicare & Medicaid Services (CMS), or Medicare.gov.
No Warranties: The Service and all plan information, content, and materials are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind. We expressly disclaim all guarantees regarding the accuracy, completeness, or timeliness of the data provided by insurance carriers.
Liability Cap: To the fullest extent permitted by law, our maximum aggregate liability to you for any claims arising out of or relating to this Agreement or your use of the Service shall be limited to ten thousand U.S. dollars ($10,000).
6. Third-Party Services & Links
For your convenience, our Service may provide links to third-party websites, such as Medicare.gov or individual insurance carrier sites. These links are provided for informational purposes only. We do not control, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we are not responsible for:
The final plan enrollment processes conducted on carrier websites.
The adjudication of insurance claims by carriers.
7. Dispute Resolution & Governing Law
Mandatory Arbitration: Any dispute or claim relating to this Agreement or your use of the Service shall be resolved through binding, individual arbitration administered by JAMS, rather than in court. You agree to waive your right to a jury trial and to participate in class-action lawsuits or class-wide arbitration.
Governing Law: This Agreement and any disputes shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles.
Pre-Arbitration Negotiation: Prior to initiating arbitration, the parties agree to first attempt to negotiate any dispute informally for a period of at least 60 days.
8. CMS Compliance
We strictly adhere to all Medicare Marketing Guidelines established by the Centers for Medicare & Medicaid Services (CMS). Our compliance measures include:
Recording all enrollment-related telephone calls for quality assurance and compliance monitoring.
Maintaining a clear separation between educational content and plan-specific marketing materials.
Providing all required CMS disclosures and communications in a clear and conspicuous manner.
9. Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
Providing false or misleading Medicare eligibility information.
Violating any CMS marketing rules or regulations.
Attempting to initiate or facilitate a fraudulent enrollment.
10. Privacy
Your privacy is important to us. Our Privacy Policy, which describes how we collect, use, and disclose your personal information, is expressly incorporated into this Agreement by reference. By using the Service, you consent to the practices described in our Privacy Policy.
